Rules

Organizers

  1. The You could win a Lexus RX 450h or $60,000 in cash! contest is organized and held by Security National Insurance Company and Primmum Insurance Company (each referred to hereinafter as an “Organizer” or, collectively, the “Organizers”), which can issue home, Recreational Vehicle* and automobile* insurance policies under the business name TD Insurance Meloche Monnex.

  2. Void. *Due to provincial legislation, our automobile and Recreational Vehicle insurance products are not offered in British Columbia, Manitoba or Saskatchewan.  Therefore, the contest is void in these three (3) provinces with respect to entries in connection with automobile and Recreational Vehicle insurance. During the contest period, should provincial legislation in any given province restrict the availability of any insurance product offered by the Organizers, the contest will be void only with respect to that particular restriction.

  3. The Prize supplier is neither an organizer nor a sponsor of this contest.


Contest period

  1. The contest will run from January 9, 2012 to January 31, 2013 at 11:59 p.m. (Eastern Time “ET”) (referred to hereinafter as the “Contest Period”).


Eligibility

  1. This contest is open exclusively to physical persons who meet the following criteria during the Contest Period and at the time of the draw (“Eligible Participants”):
  • reside in Canada and have reached the age of majority where they reside;
  • are members or employees of an Employer or Professional & Alumni group (“Eligible Group”) that has entered into an insurance affinity Agreement (the “Agreement”) with one of the Organizers which entitles them to receive group insurance rates.  Based on the Agreement entered into by each Eligible Group, persons entitled to receive group insurance rates who are thus eligible to participate in the contest, subject to the other conditions of eligibility, include members and employees themselves but may also include their spouses and children, and the students, alumni, faculty, staff and retirees of each Eligible Group. For more information on who is entitled to receive group insurance group rates for each specific Eligible Group, please consult your group or contact one of the Organizer’s Client Services representatives.
In addition, Eligible Participants must meet one of the following conditions during the Contest Period:
  • provide one of the Organizers with the expiry date of their home or private passenger automobile insurance policy; or
  • request/agree to receive a quote on home insurance or private passenger automobile insurance, or motor home, trailer, snowmobile, all-terrain vehicle or motorcycle insurance policy (“Recreational Vehicle”) insurance from one of the Organizers; or
  • hold a home, private passenger automobile or Recreational Vehicle insurance policy from one of the Organizers during the Contest Period.
  1. The following persons are not eligible to participate in the contest:
  • The Organizer and its affiliated companies (defined as all of the companies affiliated with The Toronto Dominion Bank), their employees, representatives and mandatories, advertising or promotion agencies, and the persons with whom they are domiciled may not enter this contest.
  • Those who belong to a group of professionals, alumni, employers or other associations to which the Organizers do not offer group rates.
  • Those who provide the expiry date of their insurance policy for an antique vehicle to one of the Organizers. Those who request or agree to receive an insurance quote for an antique vehicle from one of the Organizers.
  • Those who hold an insurance policy for an antique vehicle from one of the Organizers.
How to enter
  1. No purchase necessary. No purchase is required to enter the contest nor will a purchase enhance an Eligible Participant’s chances of winning a Prize.  All Eligible Participants who provide the expiry dates of their home or private passenger automobile insurance policies or who request/agree to receive a free, no-obligation quote on home, private passenger automobile or Recreational Vehicle insurance, or who hold a home, private passenger automobile or Recreational Vehicle insurance policy from the Organizers in accordance with the present rules will automatically be entered in the contest.

  2. Odds of winning. Odds of winning depend on the total number of eligible entries received during the Contest Period.  There is a limit of one (1) entry per person per insurance category (one entry for private passenger automobile insurance, one entry for Recreational Vehicle insurance and one entry for home insurance) for a maximum of three (3) entries per Eligible Participant even if the Eligible Participant has satisfied more than one condition as described in Section 5 of these rules.

  3. Modes of entry. During the contest period some or all of the following modes of entry may be used or made available by the Organizers. The Organizers do not represent or guarantee that all the modes of entry will be made available.  However, throughout the entire Contest Period, Eligible Participants can enter the contest by using the telephone method described below.

Provide home or private passenger automobile insurance expiry dates to one of the contest Organizers:

Reply form
Eligible Participants may provide an Organizer with the expiry date of their home or private passenger automobile insurance policy. To do so, Eligible Participants must fill out the reply form distributed across Canada by mail to members of the Eligible Group. Eligible Participants must indicate their home or private passenger automobile insurance policy expiry date, first name, last name, address, city, province, postal code and telephone number on the reply form, and mail it back to one of the Organizers. Facsimiles of forms will not be accepted. Reply forms must be mailed or delivered by hand to the address indicated on the reply form before the end of the Contest Period. If mailed, a post mark bearing proof of the mailing date must appear. The Organizer is not responsible for any mail delay.

Contest coupon
Eligible Participants may also provide an Organizer with the expiry date of their home or private passenger automobile insurance policy by completing the contest coupon available at special events held by Eligible Groups during the Contest Period. Eligible Participants must indicate their home or private passenger automobile insurance policy expiry date, first name, last name, address, city, province, postal code and telephone number, and deposit the contest coupon in the specially designated box according to the instructions provided on site by the Organizers. Facsimiles of the contest coupons will not be accepted.

Electronic form
Eligible Participants may also communicate the expiry date of their home or private passenger automobile insurance policy during the Contest Period using the electronic form available at www.melochemonnex.com, www.group.tdinsurance.com or on other websites pertaining to this contest. To access the electronic form, Eligible Participants must click on the promotional banner for the You could win a Lexus RX 450h or $60,000 in cash! contest. Once Eligible Participants have reached the selected page, they must click on the “Expiry date” button and complete the electronic form by indicating their first name, last name, address, city, province, postal code, telephone number and e-mail address, along with their home or private passenger automobile insurance policy expiry date. Once the electronic form has been duly completed, Eligible Participants must click on the “Submit” button and the electronic form will be sent automatically to an Organizer.  Participants will automatically be entered in the contest, if eligible. Only electronic forms with all required fields duly completed and received during the Contest Period will be accepted for entry into the contest. (An asterisk on the form identifies the required fields.)

Eligible Participants may also provide their home or private passenger automobile insurance policy expiry date by calling toll-free 1 866 269 1371 or any of the telephone numbers listed in an Organizer’s advertising material during the Contest Period.  In addition, Eligible Participants must provide their first name, last name, address, city, province, postal code and telephone number.  For more information on how to reach the nearest office, Eligible Participants may call any of the phone numbers listed in the Organizer’s advertising material.

Request/agree to receive a home, private passenger automobile or Recreational Vehicle insurance policy quote from an Organizer

Telephone
Eligible Participants may request a home, private passenger automobile and/or Recreational Vehicle insurance policy quote or agree to receive an insurance quote for the same products from an Organizer’s Client Services representative during the contest period by calling toll-free 1 866 269 1371 or any of the telephone numbers listed in an Organizer’s advertising material during the Contest Period.  In addition, Eligible Participants must provide their first name, last name, address, city, province, postal code and telephone number as well as all the information requested to complete the home, private passenger automobile and/or Recreational Vehicle insurance quote.  For more information on how to reach the nearest office, Eligible Participants may call any of the phone numbers listed in the Organizer’s advertising material.

E-quote
Eligible Participants may also request a home, private passenger automobile and/or Recreational Vehicle insurance quote by electronic means using the electronic quote form available at www.melochemonnex.com, www.group.tdinsurance.com or on other websites pertaining to this contest during the Contest Period.  To access the electronic form, Eligible Participants must click on the promotional banner for the You could win a Lexus RX 450h or $60,000 in cash! contest, Eligible Participants may click on the “Home quote”,  “Auto quote”, “Motorcycle quote”, “ATV quote” or “Snowmobile quote” button and complete the electronic quote form.  To do so, Eligible Participants must follow the different steps of the electronic quote application and fill out all mandatory fields such as e-mail address, first name, last name, address, city, province, postal code and telephone number, as well as all the information requested to complete the electronic quote form.  Once the electronic quote form has been duly completed, Eligible Participants must click on “Submit” and the electronic quote form will automatically be sent to an Organizer.  Participants will automatically be entered in the contest if they are eligible. Only electronic quote forms with all required fields duly completed and received during the Contest Period will be accepted for entry into the contest. (An asterisk on the form identifies the required fields.)

Home, private passenger automobile or Recreational Vehicle insurance policyholders


Eligible Participants who hold a home, private passenger automobile or Recreational Vehicle insurance policy issued by an Organizer during the Contest Period will automatically be entered in the contest. Please note that all Eligible Participants who cancel or choose not to renew their home, private passenger automobile or Recreational Vehicle insurance policy during the Contest Period will nevertheless remain entered in the contest.  However, these Eligible Participants must still be entitled to receive the same Eligible Group insurance rate as the one that was applied to their policy prior to it being cancelled or not renewed at the time of the draw.


Prize

10. One (1) winner will receive one (1) prize (the “Prize”).  The winner will have a choice between:

  • An amount of $60,000 dollars Canadian;

    OR

  • One (1) 2012 Lexus RX 450h, with all basic standard features offered by Lexus Canada including freight and pre-delivery inspection, Federal air conditioning tax and environmental levies for a total value of $60,000 Canadian. All other applicable taxes will be paid by the Prize winner including sales taxes. The winner will choose and purchase the 2012 Lexus RX 450h vehicle through a licensed Lexus Canada dealership of the winner’s choice within thirty (30) days of being declared a winner and then take possession of the vehicle from said dealership. The Organizers will only be responsible for issuing payment for the purchase of the 2012 Lexus RX 450h to the licensed Lexus Canada dealership for an amount not exceeding $60,000 dollars Canadian.  The winner shall be responsible for any amount exceeding $60,000 dollars Canadian. The Prize winner shall be solely responsible for all costs related to the operation of the Prize including without limitation vehicle registration, license, fuel, gas charges and insurance.  

The total value of the Prize is sixty thousand dollars Canadian ($60,000 CDN).

  1. The vehicle won may not be identical to the one shown in the Organizers’ advertising material.

  2. Prize must be accepted as awarded and shall not be transferable.  Organizers reserve the right to substitute the Prize or Prize component for another prize of equal monetary value in the event that the Prize cannot be attributed for any reasons whatsoever.

Draw

  1. One (1) draw will be held by a representative of the Organizers at approximately 10:00 a.m. (ET) on February 18, 2013, at the Organizers’ office located at 50 Place Crémazie, 12th floor, Montréal, Québec H2P 1B6. On that date, one (1) Eligible Participant will be selected at random from all valid entries received during the Contest Period in order to award the Prize described in Sections 10, 11 and 12 above.

  2. Before contacting the selected Eligible Participant, the Organizers will verify the eligibility of the selected Eligible Participant to ensure that they have met all conditions set forth in these contest rules.  In the event that the selected Eligible Participant does not meet all conditions pertaining to these Contest Rules, the Organizers will automatically disqualify the selected Eligible Participant.  The Organizers’ decision to this effect is final and cannot be appealed.

Award of Prize
  1. Following the draw, the Organizers will contact the selected Eligible participant by telephone using the information provided by the Eligible Participant or held by the Organizers, as the case may be.  The Organizers will attempt to contact the selected Eligible Participant only once via telephone.  If the selected Eligible Participant does not contact the Organizers by telephone within ten (10) working days following the Organizers’ attempt to contact the selected Eligible Participant, the selected Eligible Participant will be declared disqualified.  The Organizers will select another Eligible Participant according to the conditions set forth in Sections 13 and 14.

  2.  The selected Eligible Participant is the person whose name appears on the reply form, the contest coupon, the electronic form, or the electronic quote form, or the person who has provided expiry dates or has accepted and/or requested an insurance quote via telephone, or the insurance policyholder.

  3. Before being declared a winner, the selected Eligible Participant must answer correctly, without assistance and within a limited time period, a mathematical skill-testing question. The question will be submitted by telephone to the selected Eligible Participant at a convenient time for the Organizers and the selected Eligible Participant.

  4. In the event that more that one person appears on the winning entry and that each person meets the eligibility conditions, all such persons will be jointly declared winners of the Prize if they meet the conditions set forth in these contest rules.  They will have to decide among themselves who will answer the mathematical skill-testing question and who will get the Prize.  In case of disagreement between them, the Organizers reserve the right to decide who will be asked the mathematical skill-testing question and to whom the Prize will be remitted.

  5. Before being declared a winner, the selected Eligible Participant must sign a general consent and release form and return it to the Organizers by mail no later than ten (10) working days after receiving the general consent and release form.  By signing this general consent and release form, the selected Eligible Participant will:
  • relieve the Organizers, their affiliated companies (defined as all of the companies affiliated with  The Toronto Dominion Bank) and agents from all liability with respect to any damages that may be sustained directly or indirectly from participation in the contest or from the acceptance and use of the Prize.
  • consent to the use by the Organizers or their representatives of the selected Eligible Participant’s name, place of residence, photographs, image, voice and/or statement regarding this contest for advertising purposes in different media such as the internet or print advertising without any compensation whatsoever.
Should the selected Eligible Participant refuse to sign the general consent and release form or fail to return this form within the specified time period, he or she will be disqualified.  The Organizers will select another Eligible Participant according to the conditions set forth in Sections 13 and 14 until the Prize is awarded.

General Conditions
  1. Participation.  By participating in this contest, the participant agrees to abide by the contest rules and by the decisions of the Organizers which shall be final on all matters.  At any time during the Contest Period, an Eligible Participant may inform the Organizers of his or her decision to withdraw from the contest by sending a written request to that effect to the following address: The You could win a Lexus RX 450h or $60,000 in cash! contest, Marketing/ Contest, 50 Place Crémazie, Montréal, Québec H2P 1B6.

  2. Disqualification.  The Organizers reserve the right to disqualify from this contest any person who has tampered with or abused any aspect of this contest or received group insurance rates without being entitled to them under an Eligible Group Agreement.  The decision to disqualify a person is at the sole discretion of the Organizers; the decision is final and cannot be appealed.

  3. Promotion.  By participating in this contest, the winner authorizes the Organizers and their representatives to use his/her name, place of residence, photographs, image, voice and/or statements regarding his/her Prize for advertising purposes (such as internet and print ads) without any compensation.

  4. LIMITATION OF LIABILITY.  BY ENTERING, TRYING TO ENTER OR REMAINING IN THIS CONTEST, THE PARTICIPANT RELEASES THE ORGANIZERS, THEIR AFFILIATED COMPANIES, THEIR ADVERTISING AND PROMOTIONAL AGENCIES, THEIR RESPECTIVE EMPLOYEES, CONSULTANTS, SUBCONTRACTORS, AGENTS, MANDATORIES AND REPRESENTATIVES FROM ANY DAMAGE WHATSOEVER, FROM ANY LEGAL SOURCE, WHICH COULD ARISE DIRECTLY OR INDIRECTLY FROM HIS OR HER PARTICIPATION, ATTEMPT TO PARTICIPATE OR REMAINING IN THE CONTEST.

  5. RELEASE.  THE ORGANIZERS, THEIR AFFILIATED COMPANIES, THEIR ADVERTISING AND PROMOTIONAL AGENCIES, THEIR RESPECTIVE EMPLOYEES, CONSULTANTS, SUBCONTRACTORS, AGENTS, MANDATORIES AND REPRESENTATIVES SHALL NOT BE LIABLE FOR THE FOLLOWING:
  • ANY LOSS, DAMAGE, INCOMPLETE, INCOMPREHENSIBLE, ERASED, MODIFIED, STOLEN, TAMPERED, UNREGISTERED OR INELIGIBLE ENTRY;
  • ANY INCORRECT OR INACCURATE INFORMATION FOUND ON ANY WEBSITE PERTAINING TO THIS CONTEST, GIVEN BY A REPRESENTATIVE OF THE ORGANIZERS OR FOUND IN ANY OF THE METHODS OF PARTICIPATION SET FORTH IN THESE CONTEST RULES;
  • ANY ERROR, FAULT, OMISSION, TEMPORARY OR PERMANENT INTERRUPTION, DELAY, FAILURE OR DEFECT IN COMPUTER COMPONENTS, WEBSITE, SOFTWARE OR LINKS, LOSS OR NON-EXISTENCE OF COMMUNICATIONS, COMPUTER OR NETWORK TRANSMISSIONS THAT AFFECT THE PARTICIPATION OF THE PERSON; AND
  • FOR ANY DAMAGE OR LOSS THAT COULD ARISE, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM DOWNLOADING ANY SOFTWARE OR BY TRANSMITTING ANY DATA RELATING TO PARTICIPATION IN THIS CONTEST. 
  1. Cancellation or modifications.  Subject to the approval of Québec’s Régie des alcools, des courses et des jeux (“Régie”) in prescribed circumstances, the Organizers reserve the right to cancel, suspend or modify any part or the entire contest for whatever reasons they deem reasonable.  Without limiting the following, reasons deemed reasonable may include a material error, an event or any human intervention that corrupts or affects the administration, security, impartiality or normal running of the contest as provided for in these rules.

  2. Resident of Québec.  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.  Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

  3. Language.  In case of discrepancy between the English and French version of these rules, the French version will prevail.
